Welcome to Medsarva Education. These Terms & Conditions explain the rules that apply when you use our website, learning platform, courses, educational content, assessments, certificates and other services offered through Medsarva Education.

Medsarva Education is the education wing of Medsarva Private Limited. In these Terms, the words "Medsarva Education", "Medsarva", "we", "us" and "our" refer to Medsarva Education and, where relevant, Medsarva Private Limited.

The words "you", "your", "learner" or "user" refer to any person who accesses, registers on, enrols in or otherwise uses the Platform or our services.

By using our Platform, you agree to these Terms, our Privacy Policy, our Refund & Cancellation Policy and any additional terms that may apply to a particular course or service.

Please read these Terms carefully before using Medsarva Education. By accessing our Platform, creating an account, enrolling in a course, purchasing a service or otherwise using our services, you confirm that you have read and understood these Terms and agree to follow them.

Where the Platform asks you to actively accept these Terms, such as by selecting an "I Agree" or similar option, that action will be treated as your electronic acceptance of the Terms to the extent permitted by applicable law.

If you do not agree with these Terms, please do not use the Platform or our services.

You must have the legal capacity required under applicable law to enter into an agreement in order to use paid services on Medsarva Education.

If you are a minor or otherwise require the consent or involvement of a parent or lawful guardian under applicable law, you must use the Platform with the required consent and supervision.

Medsarva Education may introduce additional eligibility or age requirements for particular courses, assessments, events or services where this is reasonably necessary.

Where applicable law relating to children's personal data applies to our processing activities, Medsarva Education will follow the requirements applicable to such processing.

Some features of Medsarva Education require you to create an account. When creating an account, please provide information that is accurate, complete and up to date.

Your account is intended for your personal use unless Medsarva Education has expressly agreed otherwise.

You must not create an account using another person's identity or information, impersonate another person or organisation, or create an account for a fraudulent or unlawful purpose.

If you believe someone has accessed your account without your permission, please contact us as soon as possible.

You are responsible for taking reasonable care of your login credentials and the devices through which you access your account.

Please do not share your password or knowingly allow another person to use your account where such sharing is not permitted.

Medsarva Education may temporarily restrict access to an account where we reasonably believe that the account has been compromised, misused or presents a security risk.

Any such action will be taken subject to applicable law and the circumstances of the particular case.

Please provide accurate information when registering, enrolling in courses, making payments or requesting certificates.

This may include your name, email address, contact information, educational information or other information reasonably required to provide our services.

If information supplied by you is incorrect, particularly information used for certificates or official records, please contact us so that we can determine whether it can be corrected.

Medsarva Education's handling of personal information is explained in our Privacy Policy.

Medsarva Education may provide online courses, recorded lessons, live classes, webinars, workshops, assessments, quizzes, assignments, educational resources, events and other learning services.

The content, instructors, duration, syllabus, assessment method, learning resources and access period may differ from one course to another.

We may make reasonable changes to course content where necessary to correct errors, improve the learning experience, update information, maintain the Platform or comply with applicable requirements.

Course access is provided after successful enrolment and, where applicable, successful payment and completion of any required eligibility or verification process.

Unless Medsarva Education expressly permits otherwise, your course access is personal to you and cannot be sold, transferred, rented, sublicensed or shared with another person.

Where a course has a stated access period, your access may end when that period expires.

We may restrict access where there is reasonable evidence of fraudulent activity, unauthorised sharing, serious misuse, intellectual-property infringement or another material violation of these Terms, subject to applicable law.

To use Medsarva Education, you may need a compatible computer, smartphone, tablet or other device, together with an internet connection and supported browser or software.

Technical requirements may change as our Platform develops. A device or browser that works today may not necessarily remain compatible with every future version of the Platform.

You are responsible for maintaining the device, internet connection, software and other technical requirements needed to access the Platform.

We may offer certain courses, resources or events free of charge.

Free access to a course does not automatically mean that every related service is free. For example, where clearly stated before purchase, a separate fee may apply for a certificate, assessment, examination or other optional service.

Any applicable fee will be communicated before the relevant transaction.

The price shown on the Platform is the price applicable at the time of purchase, subject to applicable taxes and any clearly disclosed additional charges.

Medsarva Education may change course prices in the future. A price change will ordinarily apply prospectively and will not change the amount already paid for a completed transaction, except where required by law or otherwise expressly agreed.

Discounts, promotional offers and coupons may have their own eligibility requirements, validity periods and conditions.

Payments may be processed through authorised third-party payment gateways or payment service providers.

When making a payment, you confirm that the information provided by you is accurate and that you are authorised to use the selected payment method.

Where payment details are processed directly by a third-party payment provider, Medsarva Education does not ordinarily store complete payment credentials such as full card details.

Third-party payment providers may have their own terms and privacy policies, which may apply to the payment transaction.

Refunds and cancellations are governed by our separate Refund & Cancellation Policy.

The applicable policy explains the circumstances in which a refund may be available, the applicable conditions and the refund processing procedure.

Nothing in these Terms or our Refund & Cancellation Policy is intended to remove or restrict any mandatory consumer right or remedy available to you under applicable law.

When you successfully enrol in a course, Medsarva Education gives you a limited, personal, non-exclusive and non-transferable right to access the course content for your own lawful educational use, subject to these Terms and the applicable course conditions.

This access does not transfer ownership of the course content or other intellectual property to you.

You must not, unless expressly permitted:

• copy or reproduce substantial portions of course content;
• sell or commercially exploit course content;
• share your course access with another person;
• upload course content to another website or platform;
• remove copyright or proprietary notices;
• create unauthorised derivative works;
• use course content to create or operate a competing service; or
• bypass technical restrictions designed to protect course access.

The reference Terms you provided similarly protect course content through a limited personal licence and restrictions on copying, commercial use, transfer and unauthorised distribution.

The Medsarva Education Platform and its materials may contain intellectual property owned by or licensed to Medsarva Private Limited or its content partners.

This may include our name, logo, branding, website design, software, graphics, videos, photographs, audio, text, course materials, assessments, illustrations and other content.

Your use of the Platform does not give you ownership of this intellectual property.

Unauthorised reproduction, distribution, modification, public display or commercial use may violate applicable intellectual property laws.

We expect learners to complete quizzes, assignments, examinations and other assessments honestly.

You must not:

• submit another person's work as your own;
• impersonate another learner;
• purchase or sell answers or completed assignments;
• manipulate assessment results;
• use unauthorised assistance where it is prohibited;
• submit false or fabricated information; or
• otherwise deliberately undermine an assessment.

Where academic misconduct is established, Medsarva Education may take appropriate action, which may include withholding or cancelling a certificate, subject to applicable law and the circumstances of the case.

Some courses may allow you to submit assignments, answers, questions, reviews, comments, feedback or other material through the Platform.

You remain responsible for the material you submit and should only submit material that you have the right to use and share.

Your submission must not knowingly infringe another person's copyright, privacy, confidentiality or other legal rights.

You give Medsarva Education permission to store, reproduce and use your submissions only to the extent reasonably necessary to provide, assess, administer and improve the relevant educational service, subject to applicable law and our Privacy Policy.

We welcome honest feedback about our courses and Platform.

Reviews and feedback should be genuine and should not contain knowingly false statements, personal attacks, confidential information or material that violates another person's rights.

We may use general suggestions and feedback to improve our courses, services and Platform without creating an obligation to compensate you merely because an idea has been implemented.

Medsarva Education should remain a safe and respectful environment for learning.

You must not use the Platform to:

• break or facilitate the breaking of applicable law;
• harass, threaten or bully another person;
• publish hateful or seriously abusive content;
• impersonate another person or organisation;
• conduct scams, fraud or deceptive activities;
• send spam or repetitive unwanted material;
• share another person's private information unlawfully;
• upload malicious or harmful material;
• interfere with another learner's use of the Platform; or
• otherwise misuse the Platform.

The reference Terms contain a similarly detailed Code of Conduct addressing harmful content, harassment, spam, scams, impersonation and unauthorised access.

You must not attempt to interfere with the security or normal operation of the Platform.

This includes attempting to:

• access another person's account without permission;
• bypass authentication or access controls;
• introduce viruses, malware or other harmful code;
• conduct denial-of-service or similar attacks;
• scrape or systematically copy protected content;
• interfere with Platform infrastructure; or
• exploit a security vulnerability for an unauthorised purpose.

Nothing in this section is intended to restrict lawful activity that cannot legally be restricted under applicable law.

Medsarva Education may use third-party services for payments, authentication, hosting, communication, analytics, video delivery, document storage and other technical functions.

We may also provide links to external websites or services for convenience or educational purposes.

Third-party services operate under their own terms and privacy policies. You should review those terms before using an external service.

A link to another website does not automatically mean that Medsarva Education endorses or controls that website.

Medsarva Education provides educational and informational content. Course material is not intended to replace individual professional advice, diagnosis, treatment, legal advice, financial advice or other specialised advice.

Information may change over time, and a course may not address every situation or individual circumstance.

Where a decision involves professional, clinical, legal or other regulated activity, you should use appropriate professional judgement and obtain independent advice where necessary.

Some Medsarva Education courses may contain healthcare, medical, physiotherapy, rehabilitation, clinical or allied-health information.

Such content is provided for educational purposes. Completing a course does not, by itself, give you a government licence, statutory registration or legal authority to practise a regulated profession.

You are responsible for ensuring that your education, registration, licence and scope of practice satisfy the requirements applicable to the place where you practise.

A Medsarva Education certificate should not be represented as a government licence, university degree, statutory professional registration or other qualification unless Medsarva expressly states that such status applies and the statement is legally accurate.

Where a course offers a certificate, the certificate will be issued only after the learner satisfies the requirements specified for that course.

Depending on the course, requirements may include:

• completing the required lessons;
• attending required sessions;
• completing quizzes or assessments;
• submitting required assignments;
• achieving a specified score; or
• meeting other course-specific requirements.

Certificate requirements may differ between courses and will be communicated through the relevant course or Platform.

Medsarva Education may maintain records necessary to verify the authenticity of certificates issued through the Platform.

A certificate may be reviewed, suspended or revoked where there is credible evidence of serious academic misconduct, identity fraud, falsified information, unauthorised course access or failure to satisfy mandatory certification requirements.

Where reasonably practicable and appropriate, Medsarva Education may provide the learner an opportunity to respond before taking final action.

Certificate verification does not mean that the certificate represents a statutory professional licence unless expressly stated.

Your privacy is important to us. Medsarva Education collects and uses personal information as described in our Privacy Policy.

Depending on the service you use, information may be processed for account creation, course delivery, assessments, certificates, payments, customer support, security, fraud prevention, service improvement and legal compliance.

Medsarva Education will handle personal data in accordance with applicable Indian data-protection and information-technology laws, including the Digital Personal Data Protection Act, 2023 and applicable rules, to the extent and from the date the relevant provisions apply to the relevant processing activity.

Medsarva Education takes reasonable measures appropriate to the nature of the information and services we provide to protect personal information and Platform systems.

However, no internet-connected system can be guaranteed to be completely secure.

You also have a responsibility to protect your account credentials, devices and information used to access the Platform.

Applicable information-technology and data-protection requirements will apply according to their scope and commencement.

We may contact you about your account, course enrolment, payments, certificates, security, support requests, important service changes and other matters necessary to provide our services.

Promotional communications, where applicable, will be handled in accordance with applicable law and the choices available to you.

Transactional or legally necessary communications may continue where permitted or required even if you choose not to receive promotional communications.

We work to keep Medsarva Education available and reliable, but we cannot promise that the Platform will always be available without interruption.

Temporary interruptions may occur because of maintenance, upgrades, technical failures, internet or network problems, third-party service failures, security incidents or circumstances outside our reasonable control.

Where reasonably practicable, we will take appropriate steps to restore affected services.

We make reasonable efforts to provide useful and accurate educational material. However, educational information may contain errors, omissions or information that becomes outdated.

Medsarva Education does not guarantee that every item of educational content will always be complete, current or suitable for every individual situation.

Where a matter has professional, clinical or other significant consequences, you should verify the relevant information through appropriate authoritative or professional sources.

To the maximum extent permitted by applicable law, Medsarva Education provides the Platform and its services on an "as available" basis.

We do not promise that the Platform will always be uninterrupted, error-free, completely secure, compatible with every device or able to meet every individual requirement.

We also do not guarantee a particular educational, professional or career outcome merely because you complete a course.

Nothing in this section excludes or limits a statutory right, consumer protection or other legal protection that cannot lawfully be excluded.

Medsarva Education respects applicable consumer-protection laws, including the Consumer Protection Act, 2019 and, where applicable to the relevant transaction and business model, the Consumer Protection (E-Commerce) Rules, 2020.

We will provide material information about our services, pricing, applicable terms and refund arrangements in accordance with applicable legal requirements.

Nothing in these Terms is intended to remove or restrict a mandatory consumer right or prevent you from approaching a competent consumer commission, statutory authority or other forum where the law gives you that right.

To the maximum extent permitted by applicable law, Medsarva Education will not be responsible for indirect, incidental, special or consequential losses arising from your use of the Platform.

Subject to mandatory statutory rights, where liability relating to a particular paid service is established, Medsarva's liability will generally be limited to the amount actually paid by you for the specific service giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

To the extent permitted by applicable law, you agree to be responsible for losses or reasonable costs arising directly from your material breach of these Terms, fraudulent use of the Platform, unlawful activity or infringement of another person's rights through content you submitted.

This provision does not transfer to you any liability that applicable law places on Medsarva Private Limited or Medsarva Education itself.

You may stop using the Platform at any time, subject to any outstanding payment or other obligations that have already arisen.

Medsarva Education may suspend or terminate access where reasonably necessary because of a material violation of these Terms, fraud, unlawful activity, serious security concerns, unauthorised account sharing, intellectual-property infringement, academic misconduct or other circumstances permitted by applicable law.

Where appropriate and legally permissible, we may provide notice or an opportunity to address the issue before taking action.

Closing an account does not necessarily mean that every record associated with it will be deleted immediately.

Medsarva Education may retain information where reasonably necessary or legally required for certificate verification, accounting and financial records, dispute resolution, fraud prevention, security, legal compliance or another lawful purpose.

Any such retention will remain subject to applicable data-protection requirements.

Medsarva Education may update its Platform, services, policies and these Terms from time to time.

We may make changes to reflect new features, changes in our services, security improvements, business requirements or changes in applicable law.

Where a material change requires notice or renewed acceptance under applicable law, we will take the appropriate steps.

The latest version will display its revision or "Last Updated" date.

Medsarva Education will not be responsible for a delay or failure caused by circumstances beyond our reasonable control.

These circumstances may include natural disasters, public-health emergencies, war, civil disturbances, government actions, telecommunications failures, major infrastructure failures, widespread internet outages, power failures or failures of critical third-party services.

This clause does not affect any statutory consumer right that cannot lawfully be excluded.

These Terms are governed by the laws of India.

Subject to mandatory statutory rights and remedies, disputes arising from these Terms or the use of the Platform may be considered by courts having competent jurisdiction in India.

Nothing in this section is intended to prevent a consumer from exercising a right to approach a consumer commission, statutory authority or other forum where such right is available under applicable law.

If a court or competent authority determines that any provision of these Terms is unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted.

The remaining provisions will continue to remain effective.

If Medsarva Education does not immediately enforce a provision of these Terms, that does not mean that we have permanently waived our right to enforce it later.

Any waiver will apply only to the specific situation for which it is given unless expressly stated otherwise.

You may not transfer your rights or obligations under these Terms where such transfer is inconsistent with these Terms or applicable law.

Medsarva Private Limited may transfer or assign its rights and obligations as part of a lawful merger, restructuring, acquisition, business transfer or similar transaction, subject to applicable law.

These Terms, together with our Privacy Policy, Refund & Cancellation Policy and any additional terms expressly applicable to a particular course or service, form the agreement governing your use of the relevant Medsarva Education services.

If a mandatory provision of applicable law conflicts with these Terms, the mandatory legal provision will prevail.

We want you to be able to raise questions, complaints and concerns easily. If you have an issue relating to your account, course, payment, certificate, refund or use of the Platform, please contact us.

Where applicable law requires Medsarva Private Limited to designate and publish specific details of a Grievance Officer or another statutory contact, those details will be provided through the appropriate Platform page or policy.
